NOTICE OF ADOPTED ORDINANCE AMENDMENTS

NOTICE IS HEREBY GIVEN that the Village Board of the Village of Birchwood adopted the following ordinance amendments at its duly noticed meeting held on March 23, 2026. These ordinances take effect upon passage and publication as required by law.

Ordinance No. 1‑2026

Conditional Use – ATV and Car Wash

This ordinance amends Chapter 28, Article II, Divisions 6 (Central Business District) and 7 (Community Business District C‑1) of the Village Code of Ordinances to add “ATV and Car Wash” as a permitted conditional use within those zoning districts.

Ordinance No. 2‑2026

Temporary Uses – Use of Storage Containers

This ordinance repeals former Section 28‑652 and adopts a new Section 28‑653, establishing updated regulations governing the temporary and permanent use of storage and shipping containers. The ordinance includes definitions, permit requirements, placement and maintenance standards, removal authority, and restrictions on residential dwelling use of containers.

Wellhead Protection Ordinance Amendments

This ordinance amends Division 2, Wellhead Protection, within Chapter 26, Article IV (Water Wells) of the Village Code to strengthen groundwater protection. Amendments include updated definitions, revised permitted and prohibited uses, separation distances, conditional use standards, regulation of nonconforming uses, and enforcement provisions.

Ordinance No. 4‑2026

Building and Land Use Permits

This ordinance amends Chapter 28 of the Village Code by creating a new Division 2 – Building and Land Use Permits. The ordinance requires both a building permit and a land use permit for regulated development, establishes application requirements, confirms Plan Commission review authority, and sets standards related to utilities, subdivisions, plan approval, and permit revocation.

Ordinance No. 5‑2026

Clarification of Building Permits and Land Use Permits

This ordinance further amends Chapter 28 to clearly distinguish the scope and purpose of building permits and land use permits, assign administrative authority between the Building Inspector and Zoning Administrator, and clarify the role of the Plan Commission in land use review and recommendations.
